8.15 Dog Control Officer may inspect a licenced kennel operation annually or as 10. OFFENCE 10.1 Every person who contravenes any of the provisions of this By-Law No. 2005- 63 is guilty of an offence and shall upon conviction thereof, forfeit and pay a penalty of not more than Five Thousand Dollars ($5,000.00) exclusive of costs and every such fine is recoverable under the Provincial Offences Act. 10.2 Set fines attached as Schedule “C” to this By-Law for the licencing and requiring of registration of dogs and for the prohibiting and regulating the running at large of dogs in the Township of Asphodel-Norwood. 10.3 If this by-law is contravened and a conviction entered, the court in which the conviction was entered or any court of competent jurisdiction may, in addition to any other remedy and to any penalty that is imposed, make an Order prohibiting the continuation or repetition of the offence by the person convicted. 11. RECORDS 11.1 Any notice given to the owner of a dog pursuant to the provisions of this by-law shall be in writing and shall be delivered to the said owner or to an adult person at the owner’s place of residence, or shall be sent to him/her by first class or registered mail. The seven (7) seven days notice specified in section 7(f) above shall be computed not including the date of delivery or mailing; 11.2 The Small Dog Control Officer/Provincial Offences Officer shall keep a written record containing a brief description of any dog seized by him/her setting out he ate, time and location of such a seizure, the date of giving notice to the owner, and of the final disposition of the dog with duplicate copies provided to the Municipality. 11.3 Any person authorized by this by-law to receive payment from an owner shall give to the person making the payment a receipt therefore from a duplicate receipt book provided for the purpose and from time to time all sums so received shall be paid into the office of the Treasurer. 12. REPEAL OF PREVIOUS BY-LAWS That all previous by-laws and amendments are hereby repealed including By-Law 98-93 and By-Law 2002-29. 13. SEVERABILITY OF PROVISIONS If any section(s) of this By-Law, or parts thereof are found by any court of law to be illegal or beyond the power of the Council to enact, such section or sections or parts thereof shall be deemed to be severable and all other sections or parts thereof of this By-Law shall be deemed to be separate and independent there from and to be enacted as such. 14. This By-Law comes into force and effect on the date of its passage.
